Terms & Conditions

1. Who you are contracting with

Demoplaybook (the "Service") is operated by PSR Software Sales Enablement GmbH ("we", "us", "our").

By creating an account, purchasing a course, or otherwise using the Service, you enter into a legally binding agreement with PSR Software Sales Enablement GmbH.

2. Acceptance of these Terms

By accessing or using the Service, you confirm that you have read, understood and agree to these Terms.

If you use the Service on behalf of a company or other organisation, you confirm that you have the authority to bind that organisation to these Terms.

You must be of legal age in your jurisdiction to use the Service.

3. The Service

The Service provides online video courses, written material, downloadable resources and related learning tools for sales, presales and solution engineering professionals.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable and revocable licence to access and use the content you have purchased or otherwise been granted access to for your own personal or internal business purposes.

Unless expressly agreed otherwise, each licence is intended for use by a single individual.

4. Accounts and Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to:

  • provide accurate information;
  • keep your information up to date;
  • notify us promptly of any unauthorised access to your account.

We reserve the right to investigate suspicious account activity and may suspend accounts that appear to be shared between multiple users or otherwise used in violation of these Terms.

5. Acceptable Use

You must not:

  • use the Service for any unlawful or fraudulent purpose;
  • infringe the intellectual property or other rights of any person;
  • share, resell, sublicense, redistribute or publicly display any course content;
  • copy or reproduce substantial parts of the Service;
  • attempt to reverse engineer, scrape, probe, bypass or circumvent technical protections;
  • upload malware or interfere with the security, integrity or operation of the Service;
  • share your account credentials or use another person's account without permission;
  • use any part of the Service or its content to train, fine-tune or develop artificial intelligence or machine learning models;
  • use the Service or its content to create competing educational products or commercial training materials.

6. Intellectual Property

All content available through the Service, including videos, text, graphics, presentations, templates, downloadable resources, software, trademarks and branding, is owned by PSR Software Sales Enablement GmbH or its licensors and is protected by applicable intellectual property laws.

Downloadable resources are licensed for your personal or internal business use only and may not be redistributed, resold or made publicly available.

Except for the limited licence expressly granted in these Terms, no ownership rights are transferred to you.

7. Payments, Taxes and Checkout

Our order process is handled by Paddle.com, our authorised Merchant of Record.

Paddle is responsible for processing payments, collecting applicable taxes, issuing invoices, handling currency conversion where applicable and processing refunds in accordance with its policies.

Your purchase is also subject to the Paddle Checkout Buyer Terms.

8. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms.

Please refer to our Refund Policy for eligibility requirements and instructions on requesting a refund.

9. Service Availability and Updates

We aim to keep the Service available at all times. However, we do not guarantee uninterrupted, secure or error-free operation.

We may:

  • update or improve course content;
  • add, modify or remove features;
  • suspend parts of the Service for maintenance or security reasons;
  • discontinue individual courses or the Service as a whole.

Where reasonably possible, we will provide advance notice of significant changes.

10. Lifetime Access

Unless otherwise stated, purchased courses include lifetime access.

For the purposes of these Terms, lifetime access means access for as long as the relevant course and the Service continue to be offered by us.

It does not guarantee that the Service or any individual course will remain available indefinitely.

11. Suspension and Termination

We may suspend or terminate your access to the Service if you:

  • materially breach these Terms;
  • fail to pay amounts due;
  • create a security or fraud risk;
  • repeatedly violate our policies.

Upon termination:

  • your right to access the Service immediately ends;
  • all licences granted under these Terms automatically terminate.

12. Disclaimer

To the fullest extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis.

We do not guarantee that:

  • the Service will always be available;
  • the content will always be complete or error-free;
  • completing any course will result in specific business outcomes, increased revenue or career advancement.

Our courses are provided solely for educational purposes.

13. Limitation of Liability

To the fullest extent permitted by applicable law, our total liability arising out of or relating to the Service shall not exceed the total amount paid by you through Paddle during the twelve (12) months preceding the event giving rise to the claim.

We shall not be liable for indirect, incidental, consequential or special damages, including loss of profits, revenue, business opportunities, goodwill or data.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law, including liability for fraud, wilful misconduct, death or personal injury caused by negligence.

14. Indemnification

You agree to indemnify and hold us harmless from any third-party claim, damage, liability or expense arising from:

  • your unlawful use of the Service;
  • your breach of these Terms;
  • content you upload or submit through the Service.

15. Force Majeure

We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from events beyond our reasonable control, including natural disasters, war, terrorism, government action, internet outages, labour disputes or failures of third-party service providers.

16. Changes to these Terms

We may update these Terms from time to time.

Where changes are material, we will notify you through the Service or by email.

Your continued use of the Service after the updated Terms become effective constitutes acceptance of the revised Terms.

17. Privacy

Your use of the Service is also governed by our Privacy Policy.

Nothing in these Terms affects any statutory privacy or data protection rights available under applicable law.

18. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict of law rules.

If you are a consumer residing in the European Union or another jurisdiction with mandatory consumer protection laws, nothing in these Terms limits any mandatory rights available to you under the laws of your country of residence.
